MINUTES
Regular Meeting of January 27, 2010 at 7:30 pm
Newtown Municipal Center, 3 Primrose Street, Newtown, CT

Commissioner Peters convened the meeting at 7:32 pm.

Pending Applications

#09-29  Newtown Transload, LLC, 30 Hawleyville Road (Housatonic Railroad Company).  Application for the removal of a violation

Commissioner Peters noted that the public hearing was closed at the last meeting and that the commissioners need more time to review the materials.  The item is tabled until the next meeting.

#09-36  Talon Ridge Builders, 9 Pecks Lane.  Application to construct an approximate 5,000 sq ft building, additional parking and septic system in a regulated area.

Michael Buturla, P.E., L.S., from The Huntington Company in Fairfield, CT, presented plans depicting existing and improved location surveys and explained their plans to construct a new building west of the existing buildings, additional parking and other details.  William Kenny explained the proposed rain garden and a new wetlands system.  The Conservation Commission may require details on the conservation easement.  The proposed self-sustaining wetlands system will be approximately 40’ x 50’.  Charles Spath stated that the building will be used as office space and assured the commission the wetlands system will remain intact.

MOD #03-54  R. Mastroni Dev., LLC, 72 Hanover Road.  Application for the modification of an existing permit.

Mr. Mastroni was present to discuss his application and asked if the reporting could be changed from weekly to monthly.  The commissioners asked him to return to the next meeting with more information.  The commission also discussed the stabilization of the slope.  Mr. Mastroni will return to the next meeting with plans and a letter requesting the change of reporting request.

MOD #08-58  Claris Construction, 164 Mt. Pleasant Road – Acme Realty.  Application for the modification of an existing permit.

John McCoy from JFM Engineering presented plans for a veterinarian hospital and reviewed a summary of site changes.  Landscape plans and the drainage system was also reviewed.  He noted there will be 14,136 less square feet of impervious surface.

Violations – Ann Astarita discussed a possible violation on 10 Johnnie Appleseed Drive that included an underground storage tank, machines and vehicles in the wetlands. It was noted that some filling has been done as well.  The tank was above ground and possibly poses a fire hazard.  

Approval of Minutes – Commissioner Pieragostini motioned to approve the minutes of January 12, 2010, Commissioner Curran seconded the motion.  The motion was approved unanimously as amended.  

The meeting was adjourned at 8:45 pm.
